Regulations of “Sky Hill Apartments”

§1 Subject of the Regulations

  • These Regulations define the scope of services provided, responsibilities, and rules for staying on the premises. They constitute an integral part of the agreement concluded by making a reservation and/or payment for the stay.
  • By making a reservation and payment, the Guest confirms that they have read and accepted the terms of these Regulations.
  • The Regulations apply to all persons staying on the premises of “Sky Hill Apartments.”
  • The Regulations are available for review on the official website.

§2 Hotel Day

  • The apartment is rented on a daily basis.
  • The hotel day lasts from 4:00 PM until 10:00 AM the following day.
  • Guests wishing to extend their stay beyond the period indicated on arrival should inform the management by 10:00 AM on the day the rental period ends. The request may be granted depending on apartment availability.
  • The facility reserves the right to refuse an extension of stay if full payment for the current period has not been made or if the Guest has violated the Regulations.
  • Guests may extend their stay for an additional fee, according to the current daily rate.

§3 Reservations and Payments

  • The basis for a reservation is full prepayment by credit card or bank transfer. All reservations are non-refundable.
  • After payment is received, the Guest will receive, 48 hours prior to arrival, an access code to common areas (building entrance door, garage gate, waste area) and to the rented apartment.
  • Non-refundable payment and no right of withdrawal
    Due to the nature of the services provided, including the automatic reservation and immediate preparation of the room for the Guest, all payments are non-refundable. By completing the payment, the User agrees to the service being fully performed before the statutory withdrawal period expires and acknowledges that they therefore waive the right to withdraw from the contract after the payment is made. Refunds are not possible.

§4 Guests’ Responsibility

  • The Guest bears full financial responsibility for any damage or destruction of the apartment’s furnishings and technical equipment caused by their fault.
  • In the event of damage, the facility reserves the right to charge the Guest’s credit card with an appropriate amount. The Guest must accept this condition when making a reservation.
  • Children under 12 years of age must remain under the constant supervision of their legal guardians, who are materially responsible for any damage caused by the children.

§5 E-Receipt

  • An e-receipt is a fiscal document in electronic form, regulated by the Act on Value Added Tax of 11 March 2004.
  • The issuance of an e-receipt requires the Client’s consent, which is granted by accepting these Regulations.
  • The Seller issues e-receipts via the system and repository of electronic fiscal receipts eparagony.pl (Spark).
  • The issuance of the e-receipt occurs through successful registration of the document in the eparagony.pl repository, accessible via a unique hyperlink sent to the Client’s email address.
  • In case of problems accessing the e-receipt, the Client should check their SPAM folder and contact the Seller.
  • The Seller may additionally send an SMS notification informing about the issuance of the e-receipt.

§6 Processing of Personal Data

  • The Seller may provide the Client’s data to an IT service provider handling the e-receipt system (phone number, email address) for the purposes of:
    a. data verification and sharing the e-receipt view;
    b. sending notifications confirming e-receipt issuance.
  • Guests’ personal data are processed in accordance with applicable laws and data protection regulations.

§7 Night Silence

  • Quiet hours are observed in the apartments between 10:00 PM and 6:00 AM.
  • Disturbing the night silence may result in a warning and potential financial penalties.

§8 Additional Provisions

  • Smoking in marked rooms and public areas of the facility is strictly prohibited. Violation of this rule will result in a charge of PLN 1000 gross per night during which smoking was detected (smell, cigarette butts, ash in the room). The smoking ban also applies to electronic cigarettes.
  • Children under 5 years of age stay free of charge; otherwise, during reservation, they are counted as adults.
  • Some apartments are pet-friendly; however, Guests must inform the staff when booking. An additional fee applies: dogs ≤6kg – PLN 60/night; dogs >6kg – PLN 100/night, covering ozone treatment and disinfection to maintain top cleanliness standards.
  • In case of damage caused by animals, the facility reserves the right to charge the Guest’s credit card. The Guest must accept this condition when making a reservation.
  • The facility is not responsible for damage to or loss of the Guest’s vehicle or its contents, nor for live animals, regardless of whether vehicles are parked in the underground garage or outside.
  • In the event of a violation of these Regulations, the facility may refuse to provide further services to the Guest. The Guest must immediately comply with staff requests, settle outstanding payments, pay for damages, and leave the premises.
  • For safety reasons, Guests should turn off the TV and radio, switch off the lights, close water taps, and lock the door when leaving the apartment.

 

 

Electronic Services Regulations

§1 General Provisions

  • These Regulations define the rules for the provision of electronic services by KJ Group Patryk Kurz-Jurek, based in Kraków, ul. Białoruska 69/30, 30-638 Kraków, NIP: 6793346497, REGON: 543116245, via the website skyhillszklarska.pl.
  • The services provided by Patryk Kurz-Jurek consist of the rental of apartments located in Szklarska Poręba.
  • By using the website skyhillszklarska.pl, the user acknowledges and accepts these Regulations.

§2 Conditions for the Provision of Services

  • To use the services provided by KJ Group Patryk Kurz-Jurek via skyhillszklarska.pl, the user must have Internet access and a device capable of browsing web pages.
  • The user is obliged to use the services in accordance with their intended purpose and to comply with the provisions of these Regulations.

§3 Registration and User Account

  • To use certain services available on the website, the user may be required to create an account by completing the registration form.
  • The user must provide truthful and up-to-date information during registration and update it whenever necessary.
  • The user bears full responsibility for all activities performed through their account.

§4 Reservations and Payments

  • Apartment reservations made via skyhillszklarska.pl are non-refundable. In the event of cancellation, the payment will not be refunded. However, in justified cases and subject to apartment availability, a date change may be possible.
  • A reservation is valid only after 100% prepayment of the total booking value.
  • Reservations are confirmed automatically once full payment has been received.
  • Payment operations are processed by PayPro S.A. Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register under KRS 0000347935, NIP 7792369887, REGON 301345068.

§5 Rights and Obligations of the User

  • The user has the right to use the services in accordance with their purpose and applicable laws.
  • The user shall not engage in any actions that could disrupt or interfere with the proper functioning of skyhillszklarska.pl.

§6 Rights and Obligations of the Service Provider

  •  KJ Group Patryk Kurz-Jurek reserves the right to temporarily suspend or permanently terminate service provision in the event of a violation of these Regulations by the user.
  • KJ Group Patryk Kurz-Jurek will make every effort to ensure that services are provided continuously and without technical interruptions.

§7 Personal Data Protection

  • The rules for processing users’ personal data are defined in the Privacy Policy available on skyhillszklarska.pl.

§8 Final Provisions

  • These Regulations enter into force upon their publication on skyhillszklarska.pl.
  • KJ Group Patryk Kurz-Jurek reserves the right to modify the Regulations. Users will be informed of any changes via the website.

  • Users’ personal data may be transferred to entities cooperating with KJ Group Patryk Kurz-Jurek solely for the purpose of providing services offered on skyhillszklarska.pl.

§6 Users’ Rights

  • Users have the right to:
    • access their personal data,
    • correct their data,
    • request deletion of data (“right to be forgotten”),
    • restrict data processing,
    • transfer data,
    • object to data processing.

§7 Cookies

Complaints

  • The Client has the right to submit a complaint regarding the services provided via email to kontakt@skyhillszklarska.pl.
  • Complaints will be reviewed within 14 calendar days from the date of receipt.
  • The Client will be informed of the result of the complaint review by email to the address from which the complaint was sent or another address provided by the Client.
  • In the event of a justified complaint, KJ Group Patryk Kurz-Jurek will take appropriate corrective actions or offer another suitable solution.
